RAFFLE RULES (AGREEMENT)


Everyone, eighteen (18) years or older, who reserves a raffle ticket at
Jewelry For Life is eligible to win. By entering, you are eligible to win any of the items listed and for which you reserved a raffle ticket for. The drawing will always take place on 120 days for the original posting, OR once we have reached the prescribed number of tickets reserved for each item. Drawings will always be held at the offices of Children's Health Advocacy, Research, Medical Education and Development, Incorporated ("C.H.A.R.M.E.D., Incorporated").

HOW TO ENTER. Simply go to JewelryForLife.org and under the RAFFLES CENTRAL tab, select the item you wish to reserve a ticket for. Your may reserve as many tickets as you would like. Upon the completion of your reservation, you are now entered to win. Your RAFFLE tickets will then arrive within one to two weeks thereafter.

ELIGIBILITY: The contest is open only to legal residents of the fifty (50) United States (including the District of Columbia), and Canada, who are at least eighteen (18) years of age at the time of entry (the "Entrants"). Employees and Vendors of C.H.A.R.M.E.D., Incorporated as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible to enter. The Contest is subject to all federal, state, municipal, provincial, territorial, and local laws and regulations.

AGREEMENT TO OFFICIAL RULES: Upon the purchase of a ticket(s), Entrant agrees to abide by and be bound by these Official Contest Rules (Agreement) and the decisions of C.H.A.R.M.E.D., Incorporated, are final and binding in all maters relating to The Contest. Winning the prize is contingent upon fulfilling all requirements as set forth herein.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in The Contest, Entrant agrees to release and hold harmless C.H.A.R.M.E.D., Incorporated from and against any claim or cause of action arising out of participation in The Contest or receipt or use of any prize including, but not limited to: [a] any technical errors, computer virus and/or bugs that may prevent an Entrant from submitting an entry; [b] tampering, unauthorized human intervention in The Contest; [c] printing errors; [d] errors in the administration of The Contest or the processing of entries; or [e] injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the Entrant's participation in The Contest or receipt of any prize. C.H.A.R.M.E.D., Incorporated reserves the right at its sole discretion, to disqualify any individual who tampers with at the entry process, and to cancel, terminate, modify or suspend The Contest in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. C.H.A.R.M.E.D., Incorporated reserves the right, at its sole discretion to disqualify any individual deemed to be [a] tampering or attempting to tamper with the entry process of the operation of The Contest or C.H.A.R.M.E.D., Incorporated's web site(s); [b] acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

GOVERNING BODY: Entrants hereby agrees that the rules (terms and conditions) set forth herein shall be governed by and construed in accordance with the laws of the State of California. If any term, provision, covenant or condition outline herein is held by a Court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions outlined here tin shall remain in full force and effect and shall in no way be affected, impaired and/or invalidated.

MODIFICATION: The terms contained herein may only be amended, modified and/or terminated upon consent of the Director and President of C.H.A.R.M.E.D., Incorporated or an authorized agent thereof.

DISPUTE RESOLUTION: In the event of any dispute concerning the validity, interpretation, enforcement or breach of any of the terms and conditions set forth herein, the dispute shall be resolved by confidential arbitration within the County of Contra Costa, California, in accordance with the then existing rules of the American Arbitration Association, and judgment upon any arbitration award may be entered by any State or Federal Court having jurisdiction thereof. The Arbitrator shall be a former or retired judge and need not be affiliated with the American Arbitration Association. The Arbitrator's decision in any such arbitration shall be final and binding on all Parties. The Parties intend this arbitration to be valid, enforceable, irrevocable and construed as broadly as possible. In the event of arbitration between the Parties to enforce or interpret any provision of the terms and conditions set forth herein, the prevailing party shall be entitled to any and all costs, including attorneys' fees, actually incurred by the prevailing party. The terms and condition set forth herein shall be governed, construed under, and interpreted in accordance with the laws of the State of California without regard to its conflicts of law principles.

NO REPRESENTATIONS: Contestants agreed that no one has relied upon any representations or statements made by any other person and/or party in relation to the terms and conditions set forth herein apart from what has been specifically set forth herein.

PRIZE AND PRIZE CONDITIONS:

Winner is responsible for
all taxes and fees associated with the price receipt and/or use.

By accepting the prize, the Winner agrees to release and hold harmless
C.H.A.R.M.E.D., Incorporated against any claim or cause of action arising out of participation in The Contest or receipt of use of the prize in question. The Winner will be responsible or all local, state and federal taxes associated with the receipt of the prize. The Winner must note that the value of the accepted prize is may be taxable as income and an IRS From 1099 will be filed in the name of the Winner for the value of the prize, and the Winner is solely responsible for all matters relating to the prize after it is awarded. If the potential Winner cannot be reached via phone and mail within ten (10) business days from the first notification attempt or if the potential winner fails to return requisite document(s) within the specified time period, or if the potential Winner is not in compliance of these Official rules, then such person shall be disqualified and, at C.H.A.R.M.E.D., Incorporated's sole discretion, an alternate winner may be selected. By accepting the prize, where permitted by law, the Winner grants to the Released Parties and those acting pursuant to the authority of C.H.A.R.M.E.D., Incorporated the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Winner's full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification.

IN NO EVENT WILL
C.H.A.R.M.E.D., INCORPORATED BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUES OF THE PRIZES.

By participating, Entrants release and agree to hold harmless
C.H.A.R.M.E.D., Incorporated from any and all liability AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASIONS OF PRIVACY that may arise from participating in The Contest or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize.

ENTIRE AGREEMENT: The terms and conditions set forth herein represent the entirety of the terms and conditions set forth herein.
